Following Lt Governor’s approval, Delhi government led by CM Arvind Kejriwal has withdrawn Rajendra Kumar’s suspension orders.
Lt Governor Najeeb Jung said that CM doesn’t have the power to suspend an IAS officer.
Rajendra Kumar was arrested by CBI on July 4 in an alleged corruption case after which he was placed deemed suspension with effect from July 4 by Ministry of Home Affairs.
Despite that, the government of Delhi issued his suspension orders on July 6 in response to which the MHA had said that there was no enabling provision under the Service Law Jurisprudence for existence of two suspension orders for one and the same cause of action.
MHA in support of its argument said that the existence of two suspension orders is likely to be used by the delinquent officer to his advantage in any litigation or proceedings that might ensue.
